피고인은 2016. 9. 16. 17:00 경 울산 동구 C에 있는 D 공원 내 노상에서 피해자 E(62 세) 가 자신에게 윷놀이를 못하게 한다는 이유로 말다툼을 하다 격분하여 주먹으로 피해자의 얼굴 부위를 3회 때리고, 멱살을 잡고 피해자의 다리를 걸어 바닥에 넘어뜨리는 등 폭행을 가하여 피해자에게 치료 일수를 알 수 없는 입술과 눈 윗부분이 찢어지는 등의 상해를 가하였다.
