Defendant shall be punished by a fine of KRW 3,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

1. Around 00:30 on July 24, 2012, the Defendant found one male complex locking containing a victim C’s cash 86,000 won, credit card 5, resident registration certificate 1, and one machine transportation card 1.

The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. Violation of the Specialized Credit Financial Business Act and fraud;

A. On July 24, 2012, around 04:16, the Defendant settled KRW 81,000 for each Madern corporate card, such as paragraph (1), by presenting the volume of his card, at the F convenience store operated by the victim E in Madon-si.

In this respect, the Defendant illegally used the lost credit card by another person, and by deceiving the victim, acquired the pecuniary benefits of 81,000 won.

B. At around 06:58 on the same day, the Defendant settled KRW 26,000 of the food value by presenting the credit card of the modern corporation, which was acquired, such as friendly job offering J and fooding, as set forth in paragraph 1, at the I restaurant operated by the victim H in G.

In this respect, the Defendant illegally used the lost credit card by another person, and by deceiving the victim, acquired the pecuniary benefits of 26,000 won.

C. At around 07:07 on the same day, the Defendant settled KRW 43,000 of the food value by presenting the modern corporation credit card, which he acquired as friendly arrest J and food, as stated in paragraph 1, by displaying it to his card holder, in a restaurant operated by the victim L in K.

In this respect, the Defendant illegally used the lost credit card by another person, and by deceiving the victim, acquired the pecuniary benefits of 43,000 won.
