Reasons
Punishment of the crime
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury on Dangerous Driving) is a person engaged in driving a gallon;
On November 24, 2014, at around 23:25, the Defendant driven the said van while under the influence of alcohol with 0.130% of alcohol concentration, and led to a four-lane road in front of the transportation point of the YUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUU.
At the time, the victim D(the age of 43) was followed by the E 5 car driven by the victim D(the age of 43) prior to the same direction, and therefore, the person engaged in driving service had a duty of care to ensure the safety distance that can be avoided when the vehicle stops.
Nevertheless, the Defendant did not find out that the said car was stopped by the stop signal that was driven by the victim D while under the influence of alcohol concentration of 0.130% due to negligence while neglecting such duty of care, and did not discover that the said car was driven by the victim D, which was driven by the Defendant, in the front part of the said van driven by the Defendant, and the rear part of the said car was driven by the victim F (36 years old) who was stopped by the stop signal at the three-lane in the same direction as the vehicle was pushed by the Defendant, and due to the shock, the said car was driven by the victim F (36 years old) who was driven by the stop signal.
As above, the Defendant suffered injury to the victim D by negligence in the course of driving the said vehicle in a situation where normal driving is difficult due to the influence of alcohol, such as climatic salt, tension, etc. for about two weeks, injury to the victim F, such as climatic salt, tension, etc. requiring approximately two weeks of treatment, and injury to the victim H(60 years of age) who was accompanied by the said G Echos car for about three weeks of treatment.
2. A defendant who violates the Road Traffic Act shall be punished on November 2014.
