A defendant shall be punished by imprisonment for three years.

Of the facts charged in the instant case, C, D, E, F, G, H, I, J, K, L, M, N, P, Q, respectively.

Punishment of the crime

1. On December 23, 1997, the Defendant operated the Z Hospital in Changwon-si, Changwon-si, and entered into a check contract under the name of the Defendant with the 153-9 branch in the Changwon-si, Changwon-si, the Bank of Korea and the 153-9 branch in the name of the Defendant and has traded the number of shares.

On November 17, 2010, the Defendant issued a check number “AC”, “30,000,000,000”, and the issuance date “F. 14 June 201, 201” in the name of the Defendant at the AB office located in Changwon-si AB, Changwon-si.

On June 14, 201, the holder of the check at issue, which was within the time limit for presentment for payment, presented the check to the above bank, but the defendant did not pay the check due to the shortage of deposit.

In addition, the Defendant issued four copies of the check number per share with a total par value of one billion won from around February 28, 201 to February 28, 201, as shown in the separate sheet of crime, and the check holder presented payment to the above bank within the time limit for presentment for payment, but failed to pay the check amount due to the shortage of deposit.

2. The Defendant is an operator of the Z hospital located in Changwon-si, Masan-si.

The Defendant had worked as a nurse from October 5, 2009 to May 10, 201 at the above hospital and had retired workers AD on March 201, 201, and did not pay 582,728 won of the wages of 582,728 on March 3, 201 to her retired workers without any agreement to extend the due date until 14 days have passed from the date of retirement, as stated in the “detailed statement of delayed payment by individual” in attached Form 1, the Defendant did not pay 102 employees the total amount of wages of 1,272,05,967 won, and retirement pay to her 102 employees, as the date of retirement.

3. The Defendant: (a) operated the Z hospital in Changwon-si, Changwon-si; and (b) around July 2010, the Defendant took a total of KRW 10,000,000 with respect to the above hospital’s liability; and (c) due to business difficulties, the Defendant was unable to pay wages to the hospital employees, and thus, (d) paid money from the victim AE.
