1. As to KRW 1,329,952,952 among the Plaintiff and KRW 1,138,074,350 among the Plaintiff, the Defendant shall start from March 24, 2017, and from March 191,878.

1. As to the cause of claim

A. The Plaintiff’s assertion 1) The Plaintiff guaranteed the principal and interest obligation of the Plaintiff Company B (hereinafter “B”) to the financial institutions, and the Defendant jointly and severally guaranteed the obligation set forth in the guarantee agreement, and thus, the Plaintiff is obligated to pay the amount stated in the claim to the Plaintiff. 2) The Defendant’s credit guarantee amount of KRW 648,00,000 for the Defendant’s guaranteed amount is against the Defendant’s loan to C (hereinafter “C”), and it is not against the Defendant’s loan, and the Defendant is not a joint and several surety.

B. The facts of recognition 1) C was established on October 15, 2008, and was merged with B and dissolved on November 6, 2013, and the defendant was in the office of representative director from the time of establishment to the time of merger dissolution. B was established on July 15, 2008, and the defendant was in the office of representative director on March 20, 2015. The plaintiff is in office as listed below. (2) The plaintiff guarantees the principal and interest of financial institutions C and B as listed in the table. In the event the plaintiff fulfills the guaranteed obligation, C and B guarantee amount, (1) the unpaid guarantee fee, overdue guarantee fee, additional guarantee fee, and performance guarantee fee (the late guarantee fee shall be calculated by multiplying the unpaid guarantee fee by the annual rate of 10% if the plaintiff fails to pay the guarantee fee within the due date, and the additional guarantee fee shall be calculated within the agreed rate of 10% per annum for the performance of the guaranteed obligation and the performance guarantee fee (the additional guarantee fee shall be included within the agreed rate of 10% per annum per annum.).
