A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The KIKO Securities Co., Ltd. held stocks and futures option investment meetings in the name of 8 weeks from October 04, 201 to November 25, 201, under the name of 201, '2011 KIKO 2011 Investment Competition' against customers holding the KIKO Securities Account for the purpose of increasing royalties to customers of KIKO securities and strengthening customer relations.

Accordingly, the Defendant: (1,487,960 note) less than the number of shares of the personal information and communication (1,487,960 note) and less the average trading volume; (2) using the fact that the number of shares of the personal information and communication is a situation in which the market price can be increased through a small amount of purchase order, the Defendant intended to buy the shares of the personal information and communication and sell the shares at a high price, to acquire profits from the market price by selling them at a high price, and at the same time, to acquire prize money in the said KIKO Securities Investment Competition.

No person shall trade, entrust or be entrusted with, securities or derivatives in the market with an intention to attract anyone to trade listed securities or exchange-traded derivatives in violation of the Financial Investment Services and Capital Markets Act, creating a misleading appearance of active trading or causing a fluctuation in the market price of such securities or derivatives;

Nevertheless, from November 10, 201 to November 23, 2011, the Defendant purchased 10,087 shares of the personal securities account in the name of the Defendant (Account Number E), new investment securities account (Account NumberF), treatment securities account (Account Number G), D’s key securities account in the name of name (Account Number H), I’s alternative securities account (J), and KIKO securities account (Account Number K) in the process of purchasing 433,223 shares of the personal securities of a corporation listed on KOSDAQ, a corporation listed on the KOSDAQ, from November 10, 201 to November 23, 201, and purchased 10,087 shares of the personal securities from D’s key securities account in the name of the Defendant’s name, and purchased 136,304 shares from KIKO securities and new investment securities account in the name of the Defendant.
