1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. Since November 2004, the Ministry of Land, Transport and Maritime Affairs decided that a taxi should be appropriated for a private taxi by using the quantity, such as cancellation of a license and reduction of the number of automobiles, in an area where there is no new demand for the supply of a taxi, after calculating an adequate amount of supply corresponding to the demand for each service area within the extent not exceeding it.
B. On December 16, 2005, HH established and publicly announced the “Calculation of the total number of taxis and the “mid- to long-term plan for the supply of taxi” on December 16, 2005 in accordance with the implementation plan for the total number of taxis. The main contents are that “the total number of taxis in 2005 is 630, 634, 637, 640, 640, and 643, the total number of taxis in 2008, 209, shall be 643, respectively, and the total number of taxis in 205 through 2009 shall be 23, corporate taxi, and the total number of taxis in 209 shall be 0 only private taxi.”
C. However, under the aforementioned total number of taxis of the aforementioned contents, the taxi company is difficult to seek workers because workers are not likely to obtain a personal taxi license even if they are on long-term service, and there was no possibility that the employees on long-term service of the corporation is likely to obtain a personal taxi license.
Accordingly, the taxi workers in H-si will pay compensation to the taxi company for a certain period of time or more, and the taxi company will implement a system that enables the workers who paid compensation for the reduction of their number of taxi units to obtain personal taxi licenses from H-si (hereinafter referred to as “license conversion system”), and Defendant B is the so-called H-si Council of Workers in the H-si, which is composed of the corporation taxi workers in H-si, and the so-called “Labor Council of Workers in the H-si, which is composed of the corporation taxi workers in H-si.”
