Reasons

Punishment of the crime

B The trade union is a trade union established at C Hospital, consisting of the central trade union and the branches of D Hospital, E Hospital, and F Hospital, and belongs to G H, and forward overseas training with the appointment of an exemplary member each year.

When the issue arises as the chairperson of the above Central Trade Union on April 2019 whether the annual use of overseas training is whether or not the members of the trade union participate in overseas training, the defendant prepared an official document as if he/she holds overseas training from the above Trade Union Federation, and submitted it to the hospital to enable the members of the trade union to use the official document by using the fact that overseas training conducted by the trade union itself pursuant to the provisions of the organization agreement is not an official reason, even though it does not constitute an official reason.

Around December 2, 200: (a) received from the above J a false official document from the said J to “from Jun. 4, 2019 to Jun. 8, 2019, holding overseas training of union members and exemplary union members; (b) distributed the above official document to each trade union branch; and (c) directed the participating union members to apply for use of the official document.

On the 15th of the same month, K, the chairperson of the D Hospital branch office in Yongsan-gu Seoul Metropolitan Government, upon receipt of such instructions from the Defendant, sent an official letter to the head of the D Hospital's general affairs team in Yongsan-gu, Seoul, to provide cooperation for the use of official leave, and filed an application for official leave for five members (M, N,O, P, Q). The head of the D Hospital's general affairs team who did not know that the above official notice was false, requested an official worker to review the reason for official leave.
