A, on May 10, 2007, sentenced to a suspended sentence of 2 years for a violation of the Trademark Act by the Seoul Central District Court, on January 31, 2008, sentenced to a fine of 15 million won for a violation of the Trademark Act at the Seoul Central District Court, and Defendant B was sentenced to a fine of 10 million won on May 24, 2004 at the Dong Branch of the Busan Central District Court.

The Defendants were willinged to take charge of purchasing goods for trademark use by Defendant A and selling goods for trademark use by Defendant B.

No one shall use or possess for the purpose of having another person use a trademark identical with or similar to the registered trademark of another person on goods identical with or similar to the designated goods, possess tools for the purpose of forging or forging the registered trademark of another person, or possess goods identical with or similar to the designated goods on which another person's registered trademark is indicated for the purpose of transferring or delivering such goods

그럼에도 불구하고 피고인들은 함께, 2012. 6.경부터 경기 하남시 E에 있는 창고에서, 피고인 A은 자신의 자금으로 상표도용 물픔을 대량으로 매입한 후 위 창고에 상표도용 물품들을 보관하고, 피고인 B은 소매상들로부터 전화를 받아 배달을 하는 방법으로 상표도용 물품을 판매하여 오던 중, 2014. 4. 21. 18:30경 위 창고에서, 상표권자 ‘샤넬’의 등록상표인 ‘CHANEL'(상표등록번호 제309448호)과 동일한 상표를 이용한 샤넬 가방 1,098점, 샤넬 지갑 2,030점 등 별지 범죄일람표 기재와 같이 4가지 브랜드의 위조 유명상표가 부착된 제품이나 상표를 위조하기 위한 용구 등 총 5,170점을 소지하였다.
