Around September 2010, the Defendant of Meptamins proposed to D at a coffee shop near the Bupyeong-gu Incheon Bupyeong-gu, Incheon, as follows: “Inasmuch as there is no record related to narcotics, and thus physical search at the airport is not strict, the Defendant would bring psychotropic drugs-related Mepta (hereinafter referred to as “philopon”) into the Republic of China at a time every three million won per page when importing psychotropic drugs into the Republic of Korea (hereinafter referred to as “copon”), and upon accepting the above proposal, D and Handphones to import them into the Republic of China (hereinafter referred to as “China”).

⑴ 피고인은 2010. 10. 22.경 먼저 중국으로 출국한 뒤, 2010. 11. 8. 14:00경 중국 산동성 청도시에 있는 E 커피숍에서 D에게 시가 3,000만원 상당의 필로폰 100g을 3뭉치로 나누어 비닐, 랩, 콘돔 등에 겹겹이 싸서 건네준 다음 불상의 항공편으로 인천국제공항을 통해 먼저 입국하고, D은 위와 같이 피고인으로부터 건네받은 필로폰을 항문에 삽입은닉하고 중국 동방항공편으로 2010. 11. 8. 21:00경 인천국제공항에 도착해 세관검색대를 통과하여 입국하고, 피고인은 2010. 11. 8. 22:00경 인천 부평구 청천동에 있는 부평구청역 매표소 앞에서 D이 위와 같이 운반하여 가져온 필로폰 100g을 건네받아 이를 수입하였다.

B.
