1. Facts of recognition;

A. On September 16, 1994, the Plaintiff concluded a new living cancer insurance contract with the Defendant Company (hereinafter “instant 1 insurance contract”).

The contents of the above insurance contract are as follows: 10,00,000 won as diagnosis benefits at the time of cancer diagnosis and confirmation; 4,000,000 won as surgery benefits at the time of cancer surgery; and 2,00,000 won per day exceeding 3 days of cancer hospitalization benefits; and the specific contents of the insurance contract are as follows.

Article 9 (Definition and Diagnosis Confirmation of Cancer) (1) The term "cancer" in this Agreement refers to a disease classified as a malicious life in the basic classification of the World Health Organization (WHO) International Disease, Injury, and Private Statistics Classification.

However, the crypary, cell, personal life and fasibio, the symptoms of which have not been shown, are excluded from the above classification, due to the crypology and the disease falling under the classification number 173 of the following table:

In the World Health Organization (WHO) Revision International Disease, Injury, and Private Statistics Classification as prescribed in the Terms and Conditions of the Maternal Life Classification Table, the diseases classified as malicious organisms mean the following diseases in the International Health Organization (WHO) 9 Revision International Diseases, Injury, and Private Statistics Classification:

1. Maternal Organisms of old and old mouths 140-149;

2. Neither 150-159 of malicious life of fire extinguishers and her uniforms;

3. Repulmonary and chestly bad living 160-165;

4. Boll, combined organizations, skins, and malicious organisms of 170-175;

5. Neither 179-189 malicious organisms of parthenogenesis;

6. Other living modified organisms of which details are unknown and of which content is 190-199.

7. As for the classification of modified international diseases, injuries and private statistics after the 10th 200-208 malicious life of the forest organization and the codinant organizations, if any, other than the above diseases, a disease under the terms and conditions shall also be included.

(2) The diagnosis and confirmation of cancer shall be conducted by a person who holds a professional doctor's license of autopsy pathology or clinical pathology, and such diagnosis shall be conducted by tissue or blood test.
