A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

On May 2, 2019, the Defendant posted a false statement to the victim G who reported this paper to the Defendant that “I wish to forward 113,000 won, including the cost of home-based sales, to home-based transfer KRW 113,00,00 to H bank account in the name of the Defendant, even though the Defendant did not have the intent or ability to send goods even after receiving the payment of goods from the victim.” However, the Defendant acquired the money from the victim to H bank account in the name of the Defendant for the purpose of sending KRW 113,00,000, including the cost of home-based sales, to H bank account in the name of the Defendant.”

2. On May 19, 2019, the Defendant posted a notice stating that he did not intend or have the ability to send goods in the Defendant’s residence located in Ansan-si E, Ansan-si, and that he had access to the Internet “F website-sharing bulletin board to sell the “Masan Rawls” (hereinafter “F”) which is a health supplement, despite that the Defendant did not intend or have the ability to send goods even after receiving the payment of goods from the victim, the Defendant would transfer the amount of KRW 68,00,000 to the victim I who reported and contacted with the Defendant.
