A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant, as the representative director of the “C” corporation in Gyeyang-gu Seoul Metropolitan City, was engaged in the business of paying to the National Health Insurance Corporation, etc. while keeping health insurance premiums, national pension premiums, industrial accident insurance premiums, employment insurance premiums, etc. withheld from around September 2018 to December 2019 by its employees.

1. Around September 28, 2018, the Defendant embezzled KRW 63,650, industrial accident insurance premium 17,290, employment insurance premium 12,350, which was withheld at the victim’s income, from the above company’s office, for the above victim’s occupational custody, and embezzled KRW 2,209,630,00, which was collected from the victim as indicated in the attached crime list from around that time to August 2019, as well as arbitrarily spent for the company’s operational funds.

2. Around September 28, 2018, the Defendant embezzled KRW 83,270, industrial accident insurance premium 22,610, employment insurance premium 16,150, which was withheld at the victim’s income, from the above company’s office, for the above victim’s business, and embezzled KRW 3,021,20,00,000, which was collected from the victim as indicated in the list of crimes in the separate list of crimes from around that time to June 2019.

3. Around September 28, 2018, the Defendant’s embezzlement against F was charged with health insurance premiums withheld at KRW 83,270, industrial accident insurance premiums KRW 22,610, employment insurance premiums KRW 16,150, which were collected from the victim F’s salary, the above company’s employees at the above company’s office, and had been arbitrarily consumed with the company’s operating funds around that time.
