A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
1. At night, at around 01:00 on December 2017, the Defendant: (a) intruded with the first floor entrance that was not corrected by the DPublic Notice Board for Victim C Management in Gwanak-gu in Seoul Special Metropolitan City, Seoul Special Metropolitan City; (b) cut off 6 ice cream in the air conditioners located in the first floor and cut off 11,00 won from the air conditioners located in the rest area of the first floor; and (c) cut off 48,800 won in total, from that time to January 2019, from that time, by taking out 6 times in the air conditioners located in the rest area of the first floor; and (d) cutting down food of KRW 11,00 in total, as shown in the annexed List of Crimes.
Accordingly, the defendant invadedd a structure at night and stolen the victims' property.
2. Intrusion upon a structure, theft;
A. From July 2018 to August 2018 of the same year, the Defendant chips with the entrance door of the first floor, which was not corrected in mind that food was stolen at the victim C management level, and then cut off 10 chips with 17,500 won in the air conditioners in the first floor, and 3,1.5 fchips in the Gu’s ham, etc.
B. From the end of October 2018 to the beginning of November of the same year, the Defendant chips with the entrance door of the first floor, which was not corrected and corrected to steal food from the point of view of the victim F management in Gwanak-gu in Seoul Special Metropolitan City, and then cut off 8,00 won of the market price from the air conditioners in the first floor room.
C. On November 29, 2018, around 11:15, 2018, the Defendant entered a chip with the entrance of the first floor where food was not corrected after having sentenced to theft from the point of view of the victim F’s chip management. On the other hand, the Defendant: (a) cut off the 3,200 won of the market price from the cooling machine located in the rest room of the first floor; and (b) cut off the 10 pages of the 3,200 won of the market price.
