A defendant shall be punished by imprisonment for six months and by a fine of twenty thousand won.

When the defendant does not pay the above fine.

Punishment of the crime

Defendant is a herb pharmacist.

1. 한약사가 한약을 조제할 때에는 한의사의 처방전에 따라야 함에도 불구하고, 피고인은 C과 공모하여, 2012. 2. 1. 경 경남 하동군 D에 있는 E에서 한의사의 처방 없이 F 약국에 근무하는 C에게 “ 한약 약재인 반하 100ｇ, 후박 60ｇ, 소엽 30ｇ, 생강 80ｇ, 숙지황 300ｇ, 산약 150ｇ, 산수유 150ｇ, 백복령 120ｇ, 목단 피 120ｇ, 택사 120ｇ 혼합하여 한약을 조제해 달라” 라는 내용의 이메일을 전송하고, C은 피고인의 주문대로 한약을 조제한 것을 비롯하여 그때부터 2016. 6. 1. 경까지 별지 범죄 일람표 기재와 같이 위와 같은 방법으로 총 609회에 걸쳐 한의사 처방전에 따르지 아니하고 한약을 조제하였다.

2. Notwithstanding the fact that a person, other than a pharmacy founder, was unable to sell drugs, the Defendant, without establishing a pharmacy, prepared herb drugs as described in paragraph (1), and sold the herb drugs to G et al. for a total of 252,751,425 won from February 1, 2012 to June 1, 2016, as shown in the list of crimes in attached Table 209.
