피고인은 2013. 11. 14. 01:50경부터 같은 날 02:01경 사이 안산시 단원구 C에 있는 'D' 편의점에서, 그의 신고를 받고 출동하여 신고 내용을 묻는 경장 E에게 위 편의점 종업원이 보는데서 오른손에 들고 있던 자신의 휴대전화로 경찰 근무모 창을 수회 치며 "육갑을 떨고 있네, 꼴깝 떨지마 새끼야, 이 자식이 까불고 있어. 병신 새끼"라는 등 10여분 동안 욕을 하여 공연히 그를 모욕하였다.
