Punishment of the crime

The Defendant is a person who sells clothes with the trade name of “C” in Busan Jung-gu.

1. The Defendant committed the crime of May 27, 2014, around 13:18, 2014, stored 214 points ( approximately KRW 809,265,000 at the fixed price) in the above store for sale purpose, as shown in the attached list 1 of the crime list, in which the Defendant stored 214 points ( approximately KRW 809,265,000 at the fixed price) of the above trademark right holder, for the purpose of sale, as indicated in the attached list 1 of the crime list, in the name of “chatts (CHCRE HEHTRS, 4049849000)” designated the designated goods in the Korean Intellectual Property Office as wall, etc. and registered with the Korean Intellectual Property Office as the designated goods.

2. 2014. 8. 28.자 범행 피고인은 2014. 8. 28. 12:50경 위 매장에서 상표권자인 미국 ‘크롬 하츠 인코포레이티드’사, 프랑스 ‘루이비똥말레띠에’사, ‘샤넬’사, 이탈리아 ‘구치오구치쏘시에떼퍼아찌오니’사가 각각 대한민국 특허청에 그 지정상품을 지갑, 스마트폰 케이스 등으로 정하여 등록한 ‘크롬하츠(CHROME HEARTS, 등록번호 제4004984890000호)’, ‘루이비통(LOUIS VUITTON, 등록번호 제4020130079833호)’, ‘샤넬(CHANEL, 등록번호 제4000555920000호)’, ‘구찌(GUCCI, 등록번호 제4009122010000호)’와 동일ㆍ유사한 상표가 부착된 지갑, 휴대폰 케이스 등 별지 범죄일람표2 기재와 같이 91점(정품시가 약 64,635,000원)을 판매 목적으로 보관함으로써 위 상표권자들의 상표권을 각 침해하였다.
