The defendant's appeal is dismissed.

“The statement is made to the effect that the victim made intimidation.” The above statement not only specifically explains the particulars of the instant case, but also includes contents unfavorable to himself/herself (the victim was punished by a fine due to the crime of assault against the defendant as to the fact that the victim spits are punished by the crime of assault against the defendant), and considering that the victim made a complaint to an investigation agency and made a case in which both parties are involved, the fact that the defendant threatened the victim can be acknowledged.

Therefore, the defendant's assertion is not accepted.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit. It is so decided as per Disposition.
