피고인은 2014. 11. 7. 14:45경 위 승용차를 운전하여 부산 사상구 감전동 감전야생화단지 체험학습장 앞 강변대로를 화명동 방면에서 을숙도 방면으로 편도 3차로 중 1차로를 따라 시속 약 90킬로미터의 속도로 진행함에 있어 졸음운전으로 전방 및 좌우 주시의무를 태만히 한 채 급차선 변경한 업무상 과실로, 때마침 진행방향 2차로에서 정상 주행 중인 피해자 C(41세) 운전의 D 포터 화물차의 운전석 뒷 적재함 부분을 피고인의 승용차 앞 범퍼부분으로 들이받아 그 충격으로 인해 피해 차량이 오른쪽으로 튕겨나가 진입로 끝 부분에 주차되어 있던 9.5톤 화물차에 부딪치게 하여 피해자로 하여금 동아대학교병원에서 치료 중 같은 달 11. 21:30경 다발성 외상으로 인한 허혈성 뇌손상으로 사망에 이르게 하였다.
