Defendant shall be punished by a fine of KRW 1,500,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

1. On January 10, 2013, the Defendant made a false statement to the victim D, who is a workplace partner, at the office located in Busan Dong-gu, Busan, stating that “If he/she lends one unit of the Ampid, he/she shall be converted to his/her name within one month after he/she used it for business and shall pay the fee.”

However, even if the defendant borrowed a plaque, he did not have any idea to pay the charges or installment, or to transfer the name, but he was registered as a bad credit holder for about ten years due to the failure to pay the 12 million won in full.

As such, the Defendant, by deceiving the victim, received one package from the victim to the victim’s seat in the same place. From around that time to June 2013, the Defendant acquired a approximately KRW 600,000 won of the market price of the said package and acquired pecuniary benefits equivalent to KRW 182,200,00 of the unpaid rate.

2. Around January 31, 2013, the Defendant obtained D’s consent on the following grounds: “Around January 31, 2013, if the Defendant borrowed the name to open a mobile phone that has been restored to credit standing after one month, it shall be converted to the name after one month, and the fee shall be paid in full.”

On the same day, the defendant filed an application for joining one mobile phone in the name of the above D, as the defendant opened a mobile phone through the opening of the mobile phone and paid the installment payment and usage fees.

However, even if the defendant opens a mobile phone, he did not think that he will pay the charges or installment charges, and he did not have the ability to pay the charges or installment charges on the same ground as the preceding paragraph.

As such, the Defendant, by deceiving the victim D, received 51 opphones as above, and took advantage of from February 2013 to May 2013, 201, acquired approximately one million won of the above opphone 51 market, and acquired pecuniary benefits equivalent to 1,574,730 won.
