1. As to the Plaintiff A’s KRW 53,43,098, Plaintiff B, C, and D respectively, KRW 31,95,399 and each of the said money on February 28, 2013.
Reasons
1. Basic facts
A. The defendant is a juristic person established for the purpose of diagnosis and treatment of cancer patients pursuant to the National Cancer Center Act (hereinafter "the defendant hospital").
(2) On February 28, 2013, the deceased E (hereinafter “the deceased”) is a patient who died (hereinafter “the instant medical accident”) after being under the control of the infertility using the mouth (hereinafter “the instant surgery”) at the Defendant Hospital. The Plaintiff A is the deceased’s husband, Plaintiff B, C, and D’s children.
B. (1) On January 2013, the Deceased was diagnosed as the back-to-face cT shooting of the instant medical accident, which was conducted on the left-hand cT shooting of the instant medical accident, by putting in the mountain part in the mountain part located in the Dongducheon-si, and was inspected on February 13, 2013. (2) As a result, the medical personnel of the Defendant Hospital confirmed, on the part of the Deceased’s body CT shooting, that 50 meters of the size of the body was caused by the back-to-face cT shooting, and decided to perform both divers cine diverseings using the mouth.
3) On February 27, 2013, the Deceased hospitalized in the Defendant Hospital to undergo the instant surgery, and moved to the operating room at around 8:20 of the same month, and on the same day at around 9:10 of the same day, the instant surgery began. 4) The Defendant Hospital’s medical professionals inserted the brus in the lower part, which is the part of the Deceased, and began to inject carbon dioxide in the mouth of the Deceased.
5) When carbon dioxide has been smoothly injected up to 0.3 liter, the Defendant hospital’s medical team converted the injecting speed to “White-water”. At this time, at around 9:27, with pressure, there was a decrease in oxygen oxide, blood pressure, and carbon dioxide pressure. (6) Accordingly, the Defendant hospital’s medical team immediately suspended operation, supplied 10% of oxygen, supplied 100% of oxygen, and administered drugs, such as ambin, from around 9:28, and confirmed the injection by continuously performing cardiopulmonary resuscitation.
