Nevertheless, around August 2018, upon Defendant A’s contact with Defendant A to purchase “the license” as referred to in paragraph (1) above, the Defendants sent it to Defendant B, and Defendant B conspired to sell “the license” as a prescription drug by delivering goods supplied by zers to the said customer.

The Defendants received KRW 550,00 from I on January 16, 2019 following the above conspiracy, and then Defendant B delivered and sold “the” 1 boxes from J building K to I in Guro-gu Seoul Metropolitan Government, and Defendant B delivered and sold “the” 1 boxes from the fourth floor of the Orcheon-gu M building in Busan, on March 21, 2019.

As a result, the Defendants conspired to sell the prescription drugs at least twice, even though they are not a pharmacy founder.

3. Defendant B’s sole criminal conduct in violation of the Pharmaceutical Affairs Act is with the “N” in charge of sex surgery and administration, which was known to the general public around June 2018.
