1. The Defendant’s KRW 80,924,880 as well as the Plaintiff’s annual rate of 5% from August 1, 2017 to May 17, 2019, and the following.

1. Basic facts

A. The Plaintiff is a company for the purpose of nursing business, etc., and the Defendant is a non-profit medical corporation for the purpose of establishing and operating medical institutions.

B. On October 12, 2012, the Plaintiff entered into a contract with the Defendant to dispatch the nursing staff to the “C convalescent Hospital” (hereinafter “instant hospital”) operated by the Defendant and to receive nursing expenses from the Defendant (hereinafter “instant contract”) with the following terms and conditions, and thereafter, the said contract was renewed on October 12, 2014, when the contract term expires.

The Defendant (the instant contract entered into as the “instant hospital,” but both of them are deemed to be the Defendant) and the Plaintiff enter into a contract with respect to the nursing service as follows in order to provide convenience to patients in need of nursing staff in the hospital.

Article 2 (Services of Nursing Personnel) Nursing personnel shall perform the following duties:

(1) Helping personal hygiene and meal services of patients.

(2) The environment shall be arranged and fixed to protect the patient's safety.

(3) A report on the situation of the patient at all times to the nurse in charge.

(4) Other hospitals shall observe all the regulations of hospitals and actively cooperate in patient treatment policies.

Article 3 (Matters to be Observed by Nursing Personnel) (1) In the event that the defendant instructs the nursing of any place, any patient or any patient, the nursing personnel shall comply with such instruction.

(2) No nursing service provider shall treat a patient unfavorably, and shall faithfully implement the nursing service of a patient in accordance with the hospital regulations and the patient treatment policy.

(a) If the nursing service provider violated the above matters, the plaintiff may immediately replace the nursing service provider upon the defendant's request.
