A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On August 2009, the Defendant forged private document at the Defendant’s house located in Seoul, around August 2009, and the fact was leased and used under the condition that the Defendant would pay only monthly rent without a deposit. However, for the purpose of borrowing money, H’s seal was affixed to the location of the real estate in the real estate site column by using a stample on the paper of the real estate lease contract using a stample, in order to borrow money. In addition, for the purpose of borrowing money, H was affixed with the name of “Seoul Yeongdeungpo-gu, Seoul” and “120 square meters” in the site column, “20 million won” in the deposit column, “2 million won” in the monthly rent column, “Seoul Yeongdeungpo-gu,” “F” in the lessor’s address column, “G” in the lessor’s resident registration number column, “H” in the lessor’s resident registration number column, and “I” in the lessee column, and then the name and seal was affixed to H’s name next to the name of the said lessor.
Accordingly, for the purpose of exercising, the Defendant forged one copy of the real estate lease agreement in the name of H, a private document on rights and obligations.
2. The Defendant used the bonds to pay in KRW 700,000 per day with the amount of the bonds to be used and paid in excess of KRW 700,000 per day and borrowed money from another person due to the circumstances such as the repayment of the existing bonds, and thus there is no intention or ability to repay the bonds even if he borrowed money from another person, and even though the above obligation to return the deposit is not de facto, the Defendant’s above “E” on October 21, 2009 through I provided the victim J with a copy of the forged real estate lease contract as described in the above paragraph (1) and provided the victim J with a deposit amount of KRW 20,000 per month and a deposit amount of KRW 30,000 per month.
‘A copy of the real estate lease contract described in paragraph (1) shall be delivered to the J who may know of the fact, and it shall be from the J of the victim.
