피고인은 2015. 7. 6. 23:30경 의정부시 가능로15번길 11 어수정어린이공원에서 피고인이 술에 취하여 공원에 있던 B외 2명에게 아무런 이유 없이 시비를 걸어서 B의 신고를 받고 출동한 의정부경찰서 C지구대 소속 순경 D이 사건경위를 청취하려 하자 “씨발놈들아 덤벼 봐 맞짱 뜰까. 좆도 아닌게 죽여 버린다”등의 욕설을 하면서 이를 제지하려는 D의 앞가슴을 몸으로 수차례 부딪히고, 오른손으로 D의 손등과 왼쪽 어깨를 때리는 등 폭행하였다.
