1. 피고인 A 피고인은 2014. 5. 31. 23:00경부터 02:00경까지 군포시 R, 2층에 있는 S에서 B 등 24명에게 연락하여 도박 참가자를 모집하고, 화투 20매를 가지고 속칭 ‘신도리짓고 땡’이라는 도박을 할 수 있도록 화투 5세트(각 세트 48매)와 매트 7개, 모포 5장 등 도박 물품 등을 준비하여 위 장소를 도박장소로 제공하고, 위와 같이 편의를 제공하는 대가로 선(일명 : 총)인 B으로부터 도박 1회당 1~2만원씩 받아 합계 30만원 상당의 이익을 취하는 등 영리를 목적으로 도박을 개장하였다.
