A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. On August 2009, the Defendant: (a) called “the Defendant using a credit card sent a credit card to pay the attorney-at-law fees for a Divorce because he/she did not cash to pay the attorney-at-law fees for a Divorce; and (b) had the card and Samsung Card possessed in the name of C.

The Defendant: (a) the Defendant: (b) had no intent or ability to normally settle the price of the said card from October 7, 2009 to November 29, 2009, even if he/she used the said card for a private purpose in addition to paying attorney’s fees; (c) had been engaged in both activities with C’s consent from the owner of the store using the card under the name of C from November 7, 2009 to November 29; and (d) had purchased goods and services in an amount equivalent to KRW 24,76,703 in total, and did not pay the price; and (d) had acquired economic benefits from the purchase of goods and services in an amount of money equivalent to the said amount of money; and (e) from September 4, 2009 to November 2, 2009 by using the Samsung Card under the name of C from November 2, 2009 to purchase goods and services equivalent to KRW 8,821,030, and did not pay the same amount of property benefits.

2. The Defendant committed the following crimes by opening a mobile phone in the name of C with the knowledge of his/her personal information while keeping a copy of C’s passport at the time of economic difficulties. The Defendant committed the following crimes with the intention of using the mobile phone without permission for small payment, etc.

(1) On December 26, 2009, the Defendant applied for a new joining of the mobile telecom in E located in YY-gu Seoul Special Metropolitan City, YY-si, and entered “C”, “F”, “F” and “H” in the resident registration number column, “F” and “H” in the contact column.
