1. Facts of recognition;

A. The Plaintiff entered a college of D University in around 2015 and is currently attending the college, and the Defendants are at all aware of the Plaintiff.

B. On April 5, 2017, the Plaintiff’s previous female-friendly job offers E, written a letter stating the Plaintiff’s personal information, “No. 15 E, who attends the D University’s University,” and the Plaintiff’s bathing and criticism against the Plaintiff, and posted it on the screen by capturing the Plaintiff’s Kakao dialogue.

After that, on June 29, 2017, F made a copy of E’s writing and image to its own Facebook and posted it.

다. 피고 B는 2017. 6. 30. 01:00경 F가 게시한 글에 “ㅂㄷㅂㄷ 개자식이당 다쳐죽여야돼 희망고문 결국 날 더 외롭고 힘들게하는일이지.. 불쨩에혀 느껴봐야앎”이라는 댓글을 작성하였다.

On November 16, 2017, Defendant B was issued a summary order of KRW 500,00 by Seoul Southern District Court Decision 2017 High Court Decision 201Da14406, and around that time, the summary order became final and conclusive.

피고 C은 2017. 6. 30. 13:10경 F가 게시한 글에 “둘다 �신이�ㅋㅋㅋㅋㅋ”이라는 댓글을 작성하였다.

On November 28, 2017, Defendant C was subject to a disposition of non-prosecution of prosecution suspension by the prosecutor of the Seoul Southern District Prosecutors' Office.

2. Determination on the cause of the claim

A. In setting the limitation between the freedom of one expression and the protection of reputation in the occurrence of liability for damages, the standard of review should be differentiated depending on whether the victim is a public figure or a private figure, and whether the expression concerns public interests or concerns purely private matters. In the case of expression on matters of public meaning, the restriction on the freedom of expression should be mitigated.
