Punishment of the crime

The Defendant is a driver of an accusation vehicle, which is a construction vehicle at the construction site of high-priced sewage works in the B Station located in Daegu Dong-gu, No. 3, 4, and 5.

On December 8, 2016, the Defendant was in the process of hosting vehicles, such as moving vehicles to the line home on 6 occasions, in order to perform construction work on the tracks Nos. 3, 4, and 5 (referred to as 326.835 km points at west) within B’s stations around 01:18.

이러한 경우 선로 중앙으로부터 건축한 계인 2.1m 이상을 이 격시켜 작업을 하여야 하는 업무상 주의의무가 있음에도 불구하고, 피고인은 이를 게을리 하여 자신의 고소작업차량 조수석 문이 열린 것을 깜빡 잊고 또한 고소작업차량 위에 있던 크레인의 붐( 오 무리) 부분이 건축한 계를 침범하게 하여 작업현장 보 근 6 선로를 지나가던 오봉 발 부산 항행 화물열차 C 열차 기관차 좌측 부분을 접촉시켜 상당부분 유리창 파손 및 측면과 컨테이너 훼손 등 약 2,000만 원 상당 품이 소 손되게 하고 피해열차 현장사고정리 등으로 약 1 시간 41 분간 지연 운행하게 하는 등 피해를 입혀 기차 교통을 방해하였다.
