1. The Defendant’s KRW 43,470,144 as well as the Plaintiff’s annual rate from July 11, 2014 to September 23, 2019, and the following.

1. Facts of recognition;

A. (1) On July 31, 2006, the Plaintiff entered into a “C” contract, including a special agreement on the payment of insurance proceeds, when the Plaintiff was hospitalized for the purpose of direct treatment with the Defendant on July 31, 2006. (2) After entering into the said insurance contract, the Plaintiff was hospitalized in a medical institution for various reasons, such as the 10th century, the technical advancement of the upper line, the heart and the body pain, and the 2nds, and the 2nds, the Plaintiff claimed insurance proceeds from February 13, 2007 to July 10, 2014, and received 72,590,144 won from the Plaintiff over 70 times.

Among them, the details of insurance proceeds received from September 2, 2009 to July 10, 2014, which the Plaintiff sought, are as shown in the attached Table “The Details of Payment of Insurance Proceeds.”

3) The Defendant, in addition to the Plaintiff, entered into a multiple insurance contract with D Co., Ltd. In addition to the Plaintiff. From February 7, 2007 to July 14, 2014, the Plaintiff was paid KRW 103,860,00 in total over 68 occasions, and KRW 31,018,50 in total over 46 times from February 22, 2007 to July 10, 2014, and KRW 31,018,501 in total from February 22, 2007 to July 10, 2014.

C. The Health Insurance Review and Assessment Service, upon receipt of a request for evaluation of the Defendant’s adequate number of days of hospitalization during the investigation process of the instant case, responded to the number of days of proper hospitalization, such as indicated in the column of “regular number of days of hospitalization” in the annexed Table of Payment of Insurance Money. The insurance money that the Defendant received from September 2, 2009 to July 10, 2014, except for the part corresponding to the above appropriate number of days of hospitalization, is the total amount of KRW 43,470,144.
