1. The Defendant’s KRW 43,447,362 as well as 6% per annum from February 1, 2019 to May 3, 2019 to the Plaintiff.

1. Facts of recognition;

A. The plaintiff is a corporation with the purpose of manufacturing and wholesale of steel structures, and the defendant is a corporation with the purpose of manufacturing and selling cars.

B. From 2018 to January 2019, the Plaintiff supplied steel materials, such as steel plates, to the Defendant, and the amount of goods unpaid as of January 2019 is KRW 53,447,362.

C. Around February 2019, the Defendant paid KRW 10 million to the Plaintiff as the price for goods.

According to the above facts finding as to the cause of the claim, the defendant is obligated to pay to the plaintiff 43,447,362 won (=53,447,362 won - 10 million won) and damages for delay calculated by the rate of 6% per annum under the Commercial Act from February 1, 2019 to May 3, 2019, the delivery date of the original copy of the instant payment order, and 12% per annum under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment.

3. In conclusion, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
