피고인은 2013. 10. 01. 01:50경 부산 연제구 B 앞 노상에서, 술에 취해 누워있는 사람이 있다는 112신고(신고번호:359)를 받고 현장에 출동한 경찰관 경사 C와 순경 D이 지갑을 옆에 흘린 채 쓰러져 있던 피고인을 발견하고 “선생님 어디 불편하십니까. 댁이 어디십니까”라고 말을 걸며 누워 있는 피고인을 깨우며 지갑을 주자, 자신을 깨웠다는 이유로 위 D에게 “우리집은 사직동이다 씨발놈아 짜바리 새끼야”라고 욕설을 하고, 이에 위 D이 “욕설은 하지 마시고 집을 말씀해주십시오”라고 말을 하며 귀가시키려 하자 “개새끼들 너네는 공무원생활 오늘로 마감이다 씨발놈아”라고 계속 욕설하며 오른손 주먹으로 위 D의 가슴 부위를 2회 강하게 밀치는 등 폭행함으로써 경찰관의 112신고 사건 처리에 관한 정당한 직무집행을 방해하였다.
