Punishment of the crime

1. The Defendant, as seen above, by deceiving the above person in distress, received 34,000,000 won from the account in the name of M on the same day and acquired it by deceit.

2. On October 25, 2012, the Defendant stated, through the above M, that “The Defendant would pay the principal and interest, etc. in 250,000 won each month until June 25, 2015, to a person in charge of loans in the name-free loan belonging to the victim new company and loan company, the victim new company and loan company, as the Defendant operated theO.”

However, in fact, from around 2000 to around 100 million won, the Defendant was in the state of being in bad credit standing, and there was no other income and there was no property in possession, so there was no intention or ability to repay the loan even if the Defendant received the loan from the victim.
