A defendant shall be punished by imprisonment for four years.

The defendant shall be ordered to complete a sexual assault treatment program for 120 hours.

Punishment of the crime

From May 2015 to November 13, 2015, the Defendant: (a) promised to marry with the victim D (here, eight years of age) in return for marriage and living together; (b) followed the victim by leaving her mother; and (c) used the victim’s right and demand to easily refuse or resisting the victim’s instruction and demand; and (d) used the victim’s mother to commit indecent act or to commit similar rape.

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Indecent Acts by force against minors under the age of 13);

A. On October 2015, the Defendant: (a) left the victim’s left chest on his/her own hand, after leaving the victim’s mother in his/her house in his/her own house and in the victim’s house located in 109 dong 303, the Defendant left the victim’s house in his/her own house; (b) left the victim’s house on his/her side; and (c) left the victim’s left chest on his/her hand.

B. On October 2015, the Defendant, at the place described in the above paragraph (a) at the same time as the above paragraph (a) was placed on the side of the Defendant’s person, and the Defendant, by hand, was only in charge of the victim’s left chest and the negative part.

On November 2015, 2015, at around 07:00, the Defendant worked at the victim’s mother at the place described in the above paragraph (a) and went out of the victim’s clothes.

Although the injured person resists at the port and escaped from the victim's room, the Defendant opened a visit, opened the victim's hand, placed the victim's hand on the bed, taken the victim's hand on the bed, prevented him from driving the victim's panty, exceeded the victim's panty by one hand, and the victim did not leave the victim's hand.

In spite of the fact, the defendant's sexual intercourse has been committed on the part of the victim.

Accordingly, the defendant committed an indecent act against the victim under 13 years of age on three occasions.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (private act committed against minors under the age of 13);

A. The Defendant is above the first morning of November 2015.
