1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On November 15, 2007, where the Plaintiff and the Defendants were the insured, and the insured received hospitalized treatment due to injury or disease, Defendant A concluded each insurance contract (the insured’s “instant first insurance contract” and the Defendant B’s “instant second insurance contract” and each of the above insurance contracts collectively referred to as “each of the instant insurance contracts”).
B. The Defendants are pro-Named and simplified, and C are the mother of the Defendants.
C. From January 19, 2009 to February 4, 2009, Defendant A received hospitalized treatment at the Daumin Daumin Hospital as of 17 days from the 17th day from January 19, 2009, as indicated in attached Table 2, from that time to July 21, 2016, Defendant A received hospital treatment for a total of 279 days, as stated in attached Table 2, and received KRW 26,404,034 from the Plaintiff as insurance money under the instant insurance contract.
From March 2, 2010 to March 6, 2010, Defendant B received hospitalized treatment at E Hospital as an engine salt, and was hospitalized for 249 days from that time until May 26, 2015, and was paid KRW 17,920,073 as insurance money under the instant Type 2 insurance contract by the Plaintiff.
Before and after the conclusion of each of the insurance contracts in this case, insurance companies including the plaintiff and the defendants are insured, insurance contracts concluded by the defendant A as contract parties, insurance premiums and admission allowances paid according thereto are as listed below:
