The defendant was the director general of the Nam-gu Incheon Metropolitan City C state, and the victim D was an employee under the supervision of the defendant as a person who was working as a local administrative officer of the above Nam-gu E Team in South-gu Office.

피고인은 2013. 1. 10. 21:00경 인천 남구 F에 있는 G노래방 1호실에서 위 남구청 C국 H과 직원들과 회식을 하던 중 피해자와 어깨동무를 한 손을 내리면서 피해자의 엉덩이를 만지고, 같은 방법으로 재차 손으로 피해자의 엉덩이를 만지면서 피해자에게 귓속말로 ‘자기 엉덩이 너무 예뻐’라고 말하고, 계속하여 위 G노래방 2호실에 피해자를 데리고 들어가 옆자리에 앉힌 후 ‘자기 너무 예뻐’라고 수회 말하면서 손으로 피해자의 손을 만지고, 피해자의 머리카락을 쓰다듬고, 양손으로 피해자의 어깨부위를 잡고 껴안으려고 함으로써 업무 관계로 피고인의 감독을 받는 피해자를 위력으로 추행하였다.
