A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who was the director of C Child Care Center in Si Heung-si, B apartment 101 Dong 104.

No person shall receive or divert subsidies by fraud or other improper means.

Nevertheless, the Defendant, in collusion with D for the purpose of receiving a subsidy, registered D as a regular teacher in the Integrated Information System for Infant Care (C.I.S) from March 2, 2012 to the above Child Care Center (C.I.S) and received KRW 200,000,000, in total, 42 times as shown in the attached Table of Crimes (1) by May 7, 2013, in collusion with D for the purpose of receiving a subsidy.

(b) No person shall receive or divert subsidies by fraud or other improper means;

Nevertheless, in collusion with E for the purpose of receiving subsidies, the Defendant received subsidies of KRW 2,380,000 in total on 24 occasions as shown in the attached Table of Crimes (2) by May 7, 2013, including that the Defendant registered E as regular teachers in the Integrated Information System for Infant Care (C.I.S) from September 10, 2012 to receive full-time teachers, and received KRW 2,380,000,000, in collusion with E, for the purpose of receiving subsidies.

(c) No person shall receive or divert subsidies by fraud or other improper means;

Nevertheless, the Defendant was falsely registered as having taken care of the child F, etc. for one half of the child care center year (year 1) at the same time and place as the above paragraph (1). As such, the Defendant received from March 2012 to April 2013 a total of KRW 10,493,140 in the attached list of crimes (as indicated in 3, the sum of KRW 14 times in total) such as receiving the basic childcare fee paid as the educational subsidy from the Si interest viewing from March 2012 to the Si interest viewing.
