1. The Defendants jointly share KRW 5,00,000 to Plaintiff A, and KRW 1,00,000 to Plaintiff C, and each of them on January 27, 2015.

1. Facts of recognition;

A. Plaintiff A (n and E) is a child enrolled in G Child Care Center located in Gangnam-gu Seoul Metropolitan Government F around January 2015, and Plaintiff C is the mother of Plaintiff A.

B. Defendant D is the head of G Child Care Center, and Defendant Child Care Safety Mutual Aid Association is a non-profit public corporation established under Article 31-2 of the Infant Care Act to prevent accidents in child care centers and to compensate for infants, children, and infant care teachers and staff who have suffered damage to their lives, bodies, or property due to accidents in child care centers.

C. The terms and conditions of mutual aid agreements concluded between Defendant D and Defendant Child-Care Safety Mutual Aid Association include a provision on the victim’s direct right to claim payment of mutual aid benefits to the effect that “if the victim is liable for damages to the victim, the victim may directly claim the mutual aid association for payment of mutual aid benefits.”

Plaintiff

A은 2015. 1. 27. 오후 4시 30분경 G어린이집 보육실 내에서 자유선택활동 시간에 친구들과 뜀박질 놀이를 하며 놀던 중 중심을 잃고 넘어지면서 얼굴이 바닥에 부딪히게 되었고, 그 충격으로 상악 좌우측 중절치에 치수침범이 없는 치관 파절 등의 상해를 입었다.

마. 위 보육실에는 벽쪽에 책꽂이, 피아노 등이 배치되어 있으면서 넓지 않은 공간 안쪽에 원탁형 테이블과 사각형 테이블, 선반 등이 비정형적으로 다수 배치되어 있고, 원고 A을 비롯한 2 ~ 3명의 아동들은 그 사이로 뛰어다니며 뜀박질 놀이를 하였는데, 원고 A은 테이블 사이를 우측 옆으로 깡충깡충 뛰어 가던 중 진행 방향에 돌출되어 있는 사각형 테이블을 피하여 진행하다가 중심을 잃고 넘어지면서 위와 같은 상해를 입게 되었다.
