1. The judgment of the court of first instance is modified as follows.

(1) The defendant shall enter the attached list No. 1 in the plaintiff.

1. Case summary and the presumed factual basis

A. The summary of the case is that the Plaintiff joined the golf course operated by C in lieu of the repayment of the claim for the construction cost (70 million won) against the Defendant for M&C (hereinafter referred to as “C”) and became a regular member of the golf course. The Plaintiff was transferred membership from M around April 200, and the Plaintiff claimed that he succeeded to the rights and obligations of C’s golf course members, and the Defendant succeeded to the right and obligations of C, thereby changing the name of the member of the golf course to the Plaintiff, issued and delivered the membership certificate in the name of the Plaintiff, and sought compensation for damages incurred by the Defendant’s non-performance of the change of ownership (19.8 million won in property damage and compensation for damages (20 million won in property damage) and its delay.

The judgment of the court of first instance accepted part of the Plaintiff’s claim for the performance of transfer procedure, the request for issuance of a certificate of membership, and the claim for damages (such as KRW 2 million), dismissed the remainder of the claim for damages, and appealed against the part against which the Defendant lost.

Therefore, the part of the plaintiff's property damage claim is excluded from the scope of the judgment of this court.
