1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

The plaintiff, as an overseas Korean of the U.S. nationality, entered the Republic of Korea on June 23, 1992, repeated entry and departure on the grounds of relative visits, etc., and entered the Republic of Korea on December 29, 2004 as an overseas Korean (F-4) status and stays until now.

1. Violation of the Act on the Control of Narcotics, etc. (mariana) by trading marijuana;

(a) on December 2, 2012, around 22:00 to 23:00 on the date and around 22:3:00,00, near alleyway near the residence of a foreigner in the Gangnam-gu Seoul Metropolitan Government Non-name (one-name C), purchase approximately 300,000 won to the above C and approximately 2g of marijuana;

(b) purchase approximately 300,000 won and approximately 2g of marijuana from the alleyway near the residence of the above C at around 22:00 to 23:00 on February 2, 2013;

(c) purchase approximately 22:00 to 23:00 on the date on March 3, 2013, at Seocho Park in Gangnam-gu Seoul, Gangnam-gu, Seoul, while giving approximately 300,000 won to the above C and approximately 2g of marijuana;

(d) Sale of approximately 1g of marijuana to E at the residence of the accused in Gangnam-gu Seoul Metropolitan Government D 101 after purchase of marijuana, as described in the preceding paragraph, and at least 1.50,000 won;

(e) purchase of approximately 3g of hemp from G in the alleyway near the residence of G located in Gangnam-gu Seoul Metropolitan Government on May 2, 2013 at around 21:00 to 22:00, and purchase of approximately 3g of hemp from G in the middle of May 2013;

(f) purchase approximately KRW 2.40,00,00 from June 2013 to 22.00, in the alleyway near the residence of the G, from G, about KRW 2.47,00,00;

(g) purchase approximately KRW 3.60,000,000 on July 2, 2013, in the alleyway near the G’s residence at approximately 21:0 to 22:00, from G, about KRW 3g of marijuana;

2. Violation of the Act on the Control of Narcotics, etc. (mariana) by smoking marijuana;

(a) Smoking by inserting four times more than 0.5 g of hemps on the water tank containing water in the middle of December 2, 2012 to the Hadman of December 12, 201, and inserting a fire on the water tank containing four occasions, and inserting the smoke between them into the water tank and discharging into the water tank, and inserting it into the string or cutting off the water, with a smoke added:

(b) From February 2013, 201.

2. The period shall be four times between the police officers of the above defendant's residence and the police officers of the court.
