A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On March 1, 2013, at around 05:30, the Defendant driven a BAR car with approximately 10km alcohol concentration of 0.136% while under the influence of alcohol at the section of about 10km from the influence point in the Sung-gu, Sung-si, Sungwon-si to the front road in the Dondong-ri, Kimhae-si.

2. The Defendant is a person engaged in the duty of driving Category B New Zealand XD car.

At the time and place mentioned in the preceding paragraph, the Defendant was proceeding in front of the Taedong middle school located in the Dogdong-ri, Gyeongnam-si, Kim Jong-si.

At the time, at night, and the above place was installed with the center line of yellow-line, so in such a case, a person engaged in driving service has a duty of care to thoroughly operate the front-time and to safely keep the tea.

그럼에도 불구하고 피고인은 술에 취하여 이를 게을리 하여 중앙선을 넘어 진행한 과실로 반대편 편도 2차로중 2차로 도로 가장자리에 주차된 피해자 C의 소유의 D 포터 화물차의 앞 범퍼 부분을 위 아반떼 승용차의 앞 범퍼 부분으로 들이받고, 그 충격으로 위 포터 화물차량이 뒤로 튕기며 그 뒤에 주차된 피해자 E 소유의 F 승합차의 앞 범퍼 부분까지 들이 받게 하고 위 사고로 위 포터 화물차량에 불이 나게 하였다.

Ultimately, the Defendant, by occupational negligence, destroyed the 4,348,90 Won for repair costs, and escaped without taking any measures to damage the 2,322,151 Won for the 2,32,151.
