피고인은 2013. 11. 18. 19:00경 전남 해남군 C에 있는 피해자가 운영하는 D식당 내에서 술을 마시다 피해자에게 "너 이년, 이놈 저놈하고 놀아나고 몸뚱아리 주고 다니면서 행실이 안 좋은 년"이라고 욕설하며 손바닥으로 피해자의 왼쪽 뺨을 1회 때려 약 2주간의 치료를 요하는 다발상 좌상 등의 상해를 가하였다.
