Reasons
Punishment of the crime
On March 17, 2016, the Defendant posted an online game “sale of game money 3.3 billion won” on the bulletin board of the online game “mail fluor” at a fluorial time (hereinafter referred to as “2016 Highestest 3479”) and made a false statement to the victim C who reported and contacted with the Defendant, stating that “I will send money first to the game money 3.3 billion won.”
However, in fact, the Defendant did not have the game money for sale, and was thought to use it for the cost of living with money from the injured party, so from the beginning, the Defendant did not have the intent or ability to sell the game money to the injured party.
Ultimately, the Defendant, by deceiving the victim as such, received KRW 148,00 from the victim to a new bank account under the name of the Defendant for the same day as the price for the game money in the same day. From that point to May 29, 2016, the Defendant received the total amount of KRW 2,364,00 by the same method over 15 times, such as the list of crimes in attached Table 1, from May 29, 2016.
The Defendant, around May 6, 2016, posted a notice on EPC located in Ssung City D on May 6, 2016, stating “Sales of Game money” on the Internet Game “Stop” bulletin board, and made a false statement to the victim F who contacted with the Defendant, stating that “If money is first transferred, the Defendant will send 1.7 billion money to the game machine.”
However, in fact, the defendant thought that he will receive money from the injured party to use the game money for living expenses, and therefore, he did not have the intention or ability to sell the game money from the beginning.
Ultimately, the Defendant, by deceiving the victim as such, was transferred KRW 69,700 to the Agricultural Cooperative Account under the name of the Defendant for the same day from the victim’s money in the game.
