피고인은 C, D, E, F, G과 함께 2014. 1. 24. 20:30경부터 같은 날 21:20경까지 영양군 H에 있는 I의 집에서 화투 48장을 사용하여 1점에 1,000원의 도금을 걸고 3점을 먼저 내는 사람이 이기는 방법으로 약 10회에 걸쳐 속칭 ‘3.5.7. 고스톱’이라는 도박을 함께 하였고, 같은 날 21:20경부터 같은 날 22:30경까지 위 I의 집에서 화투 20장을 사용하여 1회 최고 20만 원의 도금을 걸고 5장씩 4패로 나눈 뒤, 패를 골라서 10, 20의 숫자를 맞춘 후 남는 화투의 수가 높은 사람이 이기는 방법으로 약 20회에 걸쳐 속칭 '복줍기(도리짓고땡)'라는 도박을 함께 하였다.
