The reasoning of this court's judgment is as follows, except where "the plaintiff" is deemed "the defendant," the third, sixth and tenth of the judgment of the court of first instance, and the ground for this court's judgment is as stated in the main sentence of Article 420 of the Civil Procedure Act.

(The court of first instance is just in finding and determining the facts of the first instance even if the evidence submitted by the defendant was based on the evidence duly admitted and examined by the court of first instance, and there is no error as alleged by the defendant as the grounds for appeal).
