A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On November 6, 2018, the Defendant: (a) received a proposal from a person who assumes a false person who assumes the position of an employee of a lending company that “I will receive 5% of the amount of the loan if the loan is made in order to obtain the loan from the person who is well aware of the loan; and (b) will offer the loan upon withdrawal of account number and delivery of the money deposited in the account, with the details of deposit and withdrawal of money above the loan amount.”

In order to obtain a previous loan, the Defendant transferred a e-mail card to a scam in the name of the accused, but the account was used as a violation of the Electronic Financial Transactions Act for the purpose of committing the scam fraud, and provided the accused with the means of access, such as the account number or e-mail card, the Defendant could be used for the scaming crime. On the other hand, on November 12, 2018, the non-titled employee called the victim D to the Seoul Southern District Prosecutors' Office E-public prosecutor, misrepresenting the victim to pay 100 million won by the F bank card, and accused the victims of the settlement. For the handling of the case, the F bank G head of the Financial Supervisory Service would return money after confirmation, and the victim acquired the money by transfer from the victim to the above B bank account under the name of the defendant on the same day.
