A defendant shall be punished by imprisonment for three years.

Punishment of the crime

1. 1) 협박 피고인은 2014. 7. 15. 22:00경 위 ‘E’에 있는 피해자에게 전화하여, “당장 문 닫아라 8월 15일까지 문 닫지 않으면 너 뼛속까지 밟아 죽여 버린다.”라고 말하여 피해자를 협박하였다. 2) 업무방해 피고인은 2014. 7. 20. 20:30경부터 같은 날 22:00경까지 위 ‘E’에서, 지나가는 사람에게 피해자를 가리키면서 “야, 너 얘랑 여관 가”라고 소리를 지르고, 설거지를 하는 피해자에게 “야 씨발년아 설거지 소리 듣기 싫으니까 앉아 씨발놈들 개 좆같은 놈들이 아직 나를 모르나 본데 내 존재를 알려 주겠다.”라고 소리를 지르며 소란을 피워 손님들이 들어오지 못하게 함으로써, 위력으로 피해자의 식당영업 업무를 방해하였다.

3) On July 31, 2014, around 19:00 on July 31, 2014, the Defendant: (a) had the same attitude that the Defendant would pay the price; (b) placed 20-30 members of the Fsung branch, to which the Defendant belongs, order the Defendant to food to the victim; and (c) had been provided with food of KRW 181,000 in total at the market price from the victim’s place of business to 2:00 on the same day; and (d) the Defendant interfered with the Defendant’s business from around August 21, 2014 to around 22:00 on the same day, “A” to the victim, “I am unable to hear or listen to the horses or well kneel, kneking, continuously kneking, and kneking, and if I do not have any kned, kne.”
