Defendant shall be punished by a fine of two million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

On June 4, 2014, the Defendant was the person in charge of the accounting of the D candidate who went out to the election of C Superintendent of the Office of Education in the 6th City/Do nationwide elections.

1. Where a person in charge of accounting receives and disburses political funds through a unreported deposit account, he shall receive and disburse them through the deposit account on which a report is made to the competent election commission;

Nevertheless, on May 24, 2014, the Defendant transferred KRW 117,220 to G through one bank account in the name of E, a bank account (Account NumberF) that is a deposit account in which the Defendant did not report KRW 117,220,00 of the purchase price of the ices used for an election campaign using a ATM device installed at the Daejeon-ro, Seo-gu, Daejeon Central Branch of the NAF, Daejeon-ro, Daejeon. On the same day, the Defendant remitted KRW 90,600 to G through one bank account in the name of the above E, and remitted KRW 680,000 on June 14, 2014 to H through one bank account in the name of the above E.

Accordingly, the Defendant spent the political funds of KRW 887,820 in total over three times through the deposit account which was not reported.

2. The person in charge of accounting shall, when he makes a false accounting report on the election expenses, be prohibited from making any false entry therein without any justifiable grounds.

4. E reported as a person in charge of accounting of the D candidate from February 2014 to February 27.

3. The lower court did not receive an allowance and did not receive an allowance to assist the accounting affairs, and did not have worked in an election campaign office after April 2014, and did not receive an allowance.
