Defendant shall be punished by a fine of three million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

No person shall allow another person to deliver words, sounds, letters, pictures, images, or other things that may cause a sense of sexual shame or aversion by telephone, mail, computer, or other means of communication, with intent to arouse or satisfy his/her own or another person's sexual desire.

그럼에도 불구하고 피고인은 2020. 7. 29. 11:30 경 택배배송 일을 하던 중 서울 B에 있는 피해자 C( 여, 22세) 의 주거지에 방 문하였다가 피해자를 만나게 되자, 같은 날 19:31 경 알 수 없는 장소에서 휴대전화를 이용하여 피해자의 휴대전화 피고인은 택배 업무 과정에서 피해자의 휴대전화번호를 습득하였음 로 ‘ 아무것도 안 입으시고 흥분 대게 만들어 놓고 나 몰라 라 하시 믄 안 대 죠 한번 주시던가 앞으르로 그러지 마 세요..’ 라는 문자 메시지를 보냈다.

Accordingly, the Defendant reached the victim with a view to meeting the sexual desire, which causes sexual humiliation or aversion by telephone.
