A defendant shall be punished by imprisonment for four years.
Reasons
Punishment of the crime
1. The Defendant, while living in the so-called “defacing card” form without any particular property or income, had the victim C be unable to cope with it, deceiving the victim C to conduct the business, such as the importation of stolen goods and clothing, and had the victim received money under the pretext of investment money, etc. by borrowing it.
Therefore, the Defendant, at the office of the Defendant located in Busan, Busan, on September 28, 2010, concluded that “B” false statements are made to the Defendant, stating that “I make a false investment because I can reduce the intermediate distribution margin if I import a foreign well-known product, such as Lane and California, and deliver it to the department store, while using a micro enterprise support program to the Small and Medium Business Administration, I can reduce the intermediate distribution margin.”
However, in fact, the Defendant did not have the intent or ability to carry out the above business, and was thought to use the same as credit card payments by receiving money from the victim.
In the end, as above, the Defendant received from the victim the remittance of KRW 1,500,00 from the victim for the purpose of investment.
In addition, from around that time to April 7, 2016, the Defendant made a false statement to the victim 73 times in total, as shown in the attached Table 1, and acquired the total amount of 337,727,200 won from the victim by remitting the amount of damage.
2. The Defendant, who is demanded by the above C to verify the data pertaining to investment, committed a crime by forging a forged public document, uttering of a forged public document, fabrication of a private document, uttering of a falsified public document, and uttering of a falsified or falsified electronic document, shall be punished by forging a document related to business investment, such as a written contract, and presenting it to C.
